Terms of Service

1. Acceptance

These Terms of Service (“Terms”) govern your use of the WGAN Directory (the “Directory”), operated by WGAN Holdings Inc. (“we,” “us”). By creating an account or listing in the Directory, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Directory.

2. The Directory

The Directory lets imaging and proptech photographers create profiles so that the WGAN team, partner platforms, and clients can discover them. We may add, change, or remove features at any time.

3. Eligibility and accounts

You must be able to form a binding contract to use the Directory. You are responsible for your account credentials and for all activity under your account. Keep your login secure and tell us promptly of any unauthorized use.

4. Your information and its accuracy

You are responsible for the information you provide and confirm you have the right to share it. Keep it accurate and up to date. You grant us permission to display and use your profile information to operate the Directory and, where you have consented, to share it as described in our Privacy Policy.

5. Data sharing

How we share your information — including with WGAN Holdings Inc. and Sparks Media Group platforms and with clients looking to hire — is governed by the consents you set in your profile and by our Privacy Policy. You can change or withdraw those consents at any time.

6. No guarantee of work

The Directory is a listing and discovery service. We do not employ photographers, we are not a party to any agreement you enter with a client, and we do not guarantee that you will receive inquiries, bookings, or hires. Any engagement, pricing, scope, and payment are strictly between you and the client. You are solely responsible for the services you provide, your licensing and insurance, and compliance with applicable laws (including drone/FAA rules where relevant).

7. Acceptable use

You agree not to:

• Post false, misleading, infringing, or unlawful content, or impersonate others.
• Scrape, resell, or misuse Directory data, or attempt to access it without authorization.
• Interfere with or disrupt the Directory, or bypass security or rate limits.

8. Termination

You may delete your profile at any time by contacting us. We may suspend or remove a listing or account that violates these Terms or that we reasonably believe is harmful, unlawful, or inaccurate.

9. Disclaimers and limitation of liability

The Directory is provided “as is” and “as available,” without warranties of any kind to the fullest extent permitted by law. To the maximum extent permitted by law, WGAN Holdings Inc. will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or opportunities, arising from your use of the Directory.

10. Changes to these Terms

We may update these Terms from time to time. Material changes will be reflected by the “last updated” date above, and your continued use of the Directory after changes take effect means you accept the revised Terms.
